Non-Exclusive Topline License – How It Works

This section explains the legal and royalty terms for licensing Emma Diva toplines. It’s designed to be fair for both the topline writer (Emma Diva / Emma L.M. Sweeney) and producers creating new music with the vocals.

1. Ownership & Rights

  • Emma Diva / Emma L.M. Sweeney retains 100% of publishing rights in the topline composition (lyrics + melody).
  • The producer retains 100% of publishing rights in their instrumental composition.
  • The producer owns 100% of the masters of their recording created using the topline.
  • This is a non-exclusive license — multiple producers can license the same topline simultaneously.

2. How Royalties Work

Using your topline, producers create a track. Royalties are split between the topline and instrumental compositions:

  • Publishing: Each composition earns its own publishing royalties via PRO registration (BMI, ASCAP, PRS, etc.)
  • Mechanical royalties: Split based on the composition each party wrote — topline vs instrumental
  • Master royalties: Paid entirely to the producer who owns the recording

3. PRO Registration Guidance

  • Register your topline composition with your PRO (Emma Diva / Emma L.M. Sweeney as the sole writer).
  • Producer registers their instrumental composition with themselves as sole writer.
  • Each party’s share should reflect only the composition they contributed (100% for each).
  • Ensure the total percentage in BMI/ASCAP/PRS adds up to 200% across the two compositions.

4. Credit

  • Producers must credit: Vocal by Emma Diva
  • This is for attribution only — ownership of the topline remains with Emma Diva / Emma L.M. Sweeney

5. Why This Works for You

  • As a producer, you retain full control of your master and instrumental composition.
  • You can release commercially, on streaming platforms, downloads, sync, etc.
  • Topline vocals are fully usable for your tracks — remix, rearrange, process, or create entirely new instrumentals.
